Roe v. Wade: Constitutional Ruling or Judicial Overreach that Should be Overturned?

Like any human institution, the Supreme Court is fallible. Over the years, it has reversed itself (150 to 300 times depending on partial or full overturning). The most famous and universally supported reversal was Brown v. Board of Education overturning the “separate but equal” 1896 ruling of Plessy v Ferguson. Many conservative scholars, including what looks like a majority on the present court, believe Roe was wrongly decided and should be overturned allowing allowing abortion law to be decided democratically by state legislatures,  which in our Federal system is where the issues of safety, health, and morality are determined. Liberals believe this issue to be a Constitutionally protected right of privacy for a women prior to viability. Both accuse each other of appointing Justices based on political philosophies dressed up as judicial philosophies- “original intent” = conservative agenda and “living document” = Liberal agenda.  It’s a mess.

We hope to embrace the “better angels of our natures” and discuss whether Roe should be overturned and who should decide abortion law- the courts, state legislatures or federal.
